Buyer Title V Inspections - What to do When the Seller has no Report

Although uncommon, there are some sellers who are unable to get Title V reports.  This is pretty common with foreclosures, but there are other reasons.  Regardless, every once in a while, property comes on the market where the buyer must perform a Title V prior to purchasing the property - and no one knows how that inspection will turn out.

 

Common Assumptions When Seller Doesn't Produce Title V

 

It's very common for buyers to assume that if the seller doesn't produce a Title V, it's because he knows it will fail the inspection, and then that is the reason for not having the inspection.  Personally, I don't really think this is a good selling strategy, and most of my colleagues in the business don't either.  So, although I'm sure it happens, it's probably not the majority of cases.  There's usually some other reason for it.  If it's an estate, maybe the heirs simply can't get the money to do it, or don't have a good way to co-ordinate the logistics.  In the case of banks, they usually just don't bother - which is a huge mistake, and costs them thousands - but that's their prerogative.  My guidelines are simple: Don't eliminate a property just because of this requirement. View the property and decide on it first, then take the next steps if it's a property that might work for you.

 

How a Buyer Should Approach Doing a Title V on a Prospective Property

 

Legwork!  Off to the local Board of Health.  You're looking for two pieces of information, but you may find others.  1) The install date of the current system.  2) The last time a Title V inspection was done.  As an example, I recently did this work for a buyer and discovered that the system was only 11 years old, and had passed an inspection just 5 years ago.  Now this doesn't mean that the system will pass this time around, but with life expectancies of modern systems well in to 30 years or more, this property has a great chance of passing inspection.  If the information is not as positive - like a 50 year old system that hasn't passed since 1986 - well, it's gut-check time!

 

Risks of A Buyer Performing His Own Title V Inspection

 

The main risk, assuming you've drafted a contingency here, is that you'll be out the inspection money, which is 400-600 dollars.  Not nothing, but since you typically stand to gain about 10,000 in equity, well worth the risk.  Just make sure that you do have an out if the system fails the inspection, as you'll likely want a chance to re-negotiate.  Remember, all Title V's are supposed to be public record, so paying for the report will necessitate a copy being delivered at the Board of Health.

 

Common Title V/Title 5 Questions

Q: Does a bank in a short sale have to get title 5?

A: No, they do not. In a short Sale, the seller still needs to provide the Title V, or the buyer may have to.

 

Q: Does a bank in a foreclosure have to get Title 5?

A: No, they do not. In a foreclosure, the bank doesn't usually get the Title V. The buyer is responsible, but if they pay cash, most towns will not require a clean Title V for a year.

 

Q: Can you buy a house in MA if Title V has failed?

A: Yes, you can. But you may not be able to get a mortgage for it.

 

Q: Can a bank sell a property without a working septic?

A: Yes, they can. But other banks will not lend on the property.

 

Q: What if my septic system fails and I don't have the money to fix it?

A: Some towns have programs to allow you to borrow the money, at low rates, to fix your system. This could be a way to borrow the money and then sell your home. Alternatively, you could have the buyer take on the responsibility of the new system, but this will be more costly than the system, as outlined above.

Hudson, Massachusetts has seen the inventory grow, as we've noted throughout the last month here on the blog in most of the communities. Sales, however, are almost keeping pace, and although the metrics look to say there's been some softening for sellers, there's still plenty of motivated buyers snapping up inventory.

Analysis of Housing Market Statistics

Hopkinton, Massachusetts: What a change in Hopkinton!  We've started to see a number of towns with an explosion of inventory, but this is quite the the change - Hopkinton inventory has doubled since the last report.  Slow winter sales have trickled in the numbers, actually pushing the trailing sales number down, so Hopkinton has officially cooled off.  There's some sales in the pipeline that will make these numbers better, but I would expect the active market time to climb quickly from this point.  I'm just not sure that the buyers can absorb this many houses, at the rates they are absorbing them.  So: Buyers - if you're looking or a home a home in popular and desirable Hopkinton, now is a good time.  Don't wait for the best choices to disappear - homes are moving quickly.

Holliston, MA - Home Sales Data (May)

 

Analysis of Housing Market Statistics

Holliston, MA, Massachusetts: Well the distressed inventory numbers are better - fewer lender owned properties and the same number of short-sales. But the volume and the pace has really picked up, and shows no signs of slowing down. Buyers, if you're frustrated by purchasing in Holliston, don't forget to check out Southborough, which is a similar town (but lacks the downtown area Holliston has). The new inventory has dropped the active market time down to 130 days, and the sold time is a very healthy 127. The jump in sales activity, if it holds, will really eat up the existing inventory, and based on the information I'm looking at, it will! Seller's should be thinking of getting out there while the buyers are snapping up property.

Update on the Red Sox Rotation

At the moment, the Rotation is settling in.

 

Good thing, because despite all the hype, they haven't been very good.  The starters have an ERA of 4.00 - that's good for 10th in the american league.  Chicago, Detroit, and Cleveland are comfortably ahead in starters ERA.  Let's see what we can expect.

 

Off to the numbers:

 

Lester

This year: 2.33     Career Average: 3.48

Expectations:  Lester dodged his usual Awful April with a solid start to the season, and would probably be 6-1 if the bats hadn't been so horrible early.  Look for him to compete for a Cy Young this year.

 

 

Beckett

This year: 2.92     Career Average: 3.92

Expectations:  Beckett similarly has started strong, putting to rest any fears that he doesn't have much in the tank.  He looks good and is pitching better.  I look forward to watching him pitch tonight (going to the game tonight, by the way).

  

Buckholz

This year: 4.19     Career Average: 3.73

Expectations:  No worries here, Clay's been whacked by the long ball, but for the most part has looked solid.  I expect his numbers to improve as we work through the year.

 

Dice-K

This year: 4.64     Career Average: 4.21

Expectations:  I think Dice-K gets a bad rap.  Sure, it's painful watching him nibble.  But he gets a lot of strikeouts, and his career numbers in a Sox uniform aren't as bad as the fans and media seem to think.  Was he worth $100 Million?  No, but I bet he's still worth $80.  So he's expensive for what you get, but the life on his fastball has been good, and I think he'll have a good year this year.

 

 

Lackey

This year: 7.16     Career Average: 3.95  (My Expectation in the AL East: 4.5 ERA, a little worse than last year)

 

Josh Beckett Looking for a Win

Expectations: Lackey won ugly last year.  This year, he's looked ugly.  I "sorta" understood why the Sox brass picked him up - I thought he'd be a solid innings eater.  Sure, he'd probably be 14-12 kinda guy, but you need someone to help eat those innings (Wakefield was that guy for years, and is a risk now to do so), protect the bullpen, and compete.  I didn't think he was worth his contract, and I thought he'd suffer in the East as opposed to the West.  After all, with few exceptions, the Sox basically walked all over him in the post season when he was with Anaheim. He was no Ace.  So my expectations were low.  But this?  In his second year?  We're talking about a major problem if he doesn't right the ship.  6+ ERA is not enough to stay on the Sox.  Basically, you can't count on a pitcher at that point, and he won't be eating innings when you're giving him the hook in the fifth inning.  I expect the Sox to give him another month and then we'll see if the injury bug bites Lackey.  With their slow start, they can't afford to see him pitch like this.

 

Overall, the Sox starters haven't been that bad.  The problem is, the other starters in the league have been good and very good. Cleveland has Masterson and Tomlin pitching great - and they should come back to earth a bit, I don't think Masterson with that delivery is going to compete for the Cy Young, and Tomlin is just in his second year.  There's room for improvement for the Sox rotation, but I think what we'll probably see is some hot pitchers cool off in the rest of the league.  Last year a 4.00 ERA was good for 6th in the AL, right now it's 10th.

Analysis of Housing Market Statistics

Grafton, Massachusetts: has seen some interesting movement since the last report.  Momentum has picked up substantially (over 30%) and sales are climbing.  There's still way too much inventory, so we're still seeing the market time climb in all categories, as it officially moves to a buyers market.  But if the sales volumes keeps moving along (and the indications are it might just do that) the next report could show a better market for sellers.





  • Grafton has 125  homes (vs. 116 in the last Grafton Home Sales Report)  listed as Active.
  • Grafton had 69  houses (vs. 51) sold in the last 6 months,  and 43  homes (vs. 31) sold in the last 3 months.
  • Grafton has an Average Market Time of 173 days (vs. 140) for SOLD  homes.
  • Grafton has an Average Market Time of 232 days for ACTIVE homes.
  • Grafton has an Average Sold Price of $377,270 for sold homes.
  • Grafton has 3 properties advertised as lender owned (typically foreclosure) .
  • Grafton has 11 properties advertised as short sales required by lender .

8 Steps to Making Money When Buying a Foreclosed Home (REO)

Foreclosures are not for the Timid or those on a budget. You need access to capital (cash!) to be successful. (More Here) But once you've got that conquered, here are some tips to make sure you're covered.

 

Base Valuation on the Foreclosure House

The first thing you should do is figure out if the home is cheap (1) . It should be priced cheap as an REO, or you should decide what cheap is if it is going to auction. This generally involves a quick Market Analysis for the age, style and location of the home. There's no point in buying a foreclosure if you have to pay market value: the goal is to get a discount. Generally, I try to get two baseline numbers on a home, the baseline I would pay for a "average" foreclosure, and the actual "retail" price if its fixed up (2). Based on that differential, you can decide if the numbers work.

 

Detailed Valuation on the Foreclosure Home

Now you've got to get as detailed as you can (3). A close inspection of the lot, the exterior, the roof, and the interior if you can. The goal here is to make adjustments to the baseline numbers to reflect reality. Perhaps on-line it looked cheap, but now, standing in the driveway, the highway noise makes you think that it's going to be valued much lower than you originally thought. Or, the neighborhood will quickly pull up the value on this home. Or, the roof is no good, and you have to adjust your first baseline, due to the work involved, but not the second.

 

Liens and Tenants when Purchasing Foreclosures

More research and math coming up. First stop, public records at your registry to see what liens have been placed on the property (4). This step is not necessary if the home is being marketed - a typical transaction will put clear title on the lender. Not so at Auction! At Auction, any outstanding liens/debts become your responsibility, so you should know what they are. There could be federal tax liens, state tax liens, town liens, contractor liens - you don't know, so you need to check.

 

Double check down at the local town hall, especially if there are any town services (5). The assessors will have outstanding tax bills (common), and the water/sewer department will have water bills (also common). Some towns have their own electric and cable services, and there could be outstanding bills here as well. Both trips are necessary, as not all liens are recorded where they should be.

 

For each lien or outstanding payment that will fall in your lap, deduct those from your baseline valuation number. So if you thought the property was worth 125K, but it has 15,000 in overdue taxes, it's now worth $110 to you at Auction.

 

Also note if there's anyone living at the property (6). If they are, they are going to be your tenants after the close, whether you want them or not. Better make a budget to buy them out, if at all possible before close. I don't recommend going through the courts - takes too long and isn't (usually) any cheaper. The sooner the better! They can cause more problems while you're waiting to for purchasing to be finalized.

 

Be Smart about Improvements to a Foreclosure Home

Assume that the home needs work. Typically a lot. Make sure you have a plan for what you plan to fix, how much you'll spend on that fix, and what the home will be worth when those fixes are done (7). This plan should be 80-90% complete BEFORE you bid. If you can't see the interior at auction time, make sure you are appropriately assuming the risk. It can't be said enough, the goal here is NOT to break even. The goal should be to make a profit. If you want to break even, just buy a regular home, and save yourself the trouble. Homes without clear Title V are a special risk in this area, and wells need special care as well when you're doing your number crunching. Either or both could significantly eat into your profits.

 

Also, make sure when looking at a properties problems, you're taking proper account of things that can't be fixed. If they can't be fixed, they'll be just a painful on the way out. For example, fixing up the interior of a 2800 sq foot home with only a 1 car garage is a problem - those homes often sell at steep discounts to comparable properties with a 2 car garage.

 

On a smaller property, you'll be looking to make a profit - after carrying costs and sales fees, of at lest 40K. That's a bare minimum. 75 would be better, and 100 is a good deal. As the properties get larger, and carrying costs grow, you can probably expand that to 100-200K for typical properties.

 

There will still be Risks in Buying Any Foreclosure

Even after you've done all your math, you'll likely find more competition at your number than you'd like to see. Auctions and REO sales are pretty competitive in this area, leaving little margin for error on desirable homes. Even with all the research and crunching, you may still lose money on that foreclosure. Be prepared for that outcome(8). Happy Hunting!

  • Framingham had 188 houses sold in the last 6 months, (vs. 201) and 110 homes (vs. 99) sold in the last 3 months.
  • Framingham has an Average Market Time of 116 days (vs. 127) for SOLD homes.
  • Framingham has an Average Market Time of 143 days (vs. 171) for ACTIVE homes.
  • Framingham has an Average Sold Price of $326,212 for sold homes.
  • Framingham has 6 properties (vs. 5) advertised as lender owned (typically foreclosure) .
  • Framingham has 22 properties (vs. 19) advertised as short sales required by lender .

Analysis of Framingham Housing Market Statistics

 

Framingham, Massachusetts: An interesting note about the short sales in Framingham - 8 of them have signed offers, and are probably waiting bank approval. So there's really only about 16 left, and many are on the lower end of the market. The bank inventory is definitely enough to pull down comparables, statistics and keep a lid on prices, but I don't really see it pushing prices down - it's just not staying on the market long enough. Big jump in available inventory, and the jump in sales is coming - with 35 properties flagged that will be Sold by the next report. The average days on market for solds continues to fall, suggesting that buyers are out and being aggressive at these prices. Properties in good condition in popular locations are going fast, and are likely receiving multiple bids. (In fact, 10 homes already sold show at or above list price, a sure sign of competitive bids, that will likely increase based on these numbers...) Sellers who wish to sell should hurry up while the demand is there.
